Advanced Topics in Special Needs Planning
In this session, we'll dive into the weeds on 1st Party and 3rd Party Special Needs Trusts, ABLE Accounts, and public benefits protection for those with developmental disabilities and mental health challenges. We'll provide examples of client challenges and possible resolutions, including planning during divorce, modifying irrevocable trusts after the death of a family member, allocation of assets between neurotypical and special needs children, and how very recent changes in California laws affect planning for receiving inheritances.
Learning Objectives:
- Learn which planning tools are appropriate for which clients' challenges
- Understand the important role of a financial advisor in special needs planning, including financial projections and how to work as a team with the estate planning attorney
- Learn in which situations special needs trusts are *actually* needed, and what restrictions might result
